1. Eligibility and Account Registration

1.2 Account Accuracy: You agree to provide accurate and complete information during registration and to keep your account information up to date.
1.3 Account Security: You are responsible for safeguarding your login credentials. Any activity under your account is your responsibility.
1.4 Multiple Accounts: We reserve the right to limit or refuse multiple accounts held by the same individual or entity if deemed abusive.

2.1 Hosting Services: We provide web hosting, cloud hosting, domain registration, and related services as described on our website.
2.2 Service Scope: Each plan’s features, limitations, and pricing are published on our website and may change over time.
2.3 Third-Party Services: Some Services may rely on third-party software or infrastructure. We are not liable for interruptions caused by such providers.
3. Service Activation and Delivery
3.1 Provisioning Time: Hosting accounts are typically activated within minutes after payment is confirmed.
3.2 Domain Registrations: Domains are registered once payment clears and availability is confirmed.
3.3 Delivery Confirmation: Service details are sent to the email address provided during registration.
4. Payments, Billing, and Renewals
4.1 Fees: All fees are listed in the currency shown on our website. Prices may change with prior notice.
4.2 Billing Cycle: Services are billed in advance, either monthly, yearly, or as otherwise specified.
4.3 Auto-Renewal: Services renew automatically unless you disable auto-renew or cancel before the renewal date.
4.4 Payment Methods: We accept credit/debit cards, PayPal, and other methods shown at checkout.
4.5 Failed Payments: If a payment fails, your Services may be suspended until payment is received.
4.6 Late Fees: We reserve the right to charge late fees on overdue accounts.
5. Refunds and Cancellations

6.1 Compliance: You must comply with our AUP, which prohibits illegal activities, spam, abuse, and resource misuse.
6.2 Enforcement: Violations may result in suspension or termination without refund.
6.3 Prohibited Uses: Includes but is not limited to hosting malware, phishing, copyrighted material without permission, and running harmful scripts.
7. Service Availability and Maintenance
7.1 Uptime Commitment: We aim for 99.9% uptime but do not guarantee uninterrupted service.
7.2 Scheduled Maintenance: We may perform maintenance that may cause downtime; notice will be given when possible.
7.3 Emergency Maintenance: May be conducted without notice if necessary to protect the network or servers.
8. Data Management and Backups
8.1 Customer Responsibility: You are responsible for maintaining your own backups.
8.2 Our Backups: We perform regular backups but do not guarantee their availability or completeness.
8.3 Data Loss: We are not liable for data loss, corruption, or recovery costs.
9. Support

9.2 Scope of Support: Support is limited to issues directly related to our hosting environment.
9.3 Exclusions: We do not provide development, coding, or third-party software support.
10. Limitation of Liability

10.2 Maximum Liability: Our total liability is limited to the fees paid for the Service in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify and hold harmless Smarter Cloud Ltd, its employees, and partners from any claims, damages, or expenses arising from your use of the Services.
12. Suspension and Termination
12.1 Suspension: We may suspend your account for non-payment, AUP violations, or security risks.
12.2 Termination: We may terminate your account with notice if you breach these Terms.
12.3 Effect of Termination: Upon termination, all data may be deleted.
13. Changes to the Terms
We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of England and Wales.
