Acceptable Use Policy (AUP)

1. Introduction and Purpose

This Acceptable Use Policy (“AUP”) is part of the agreement between you (“User,” “you,” “your”) and Smarter Cloud Ltd (“we,” “us,” “our”) and applies to all hosting, domain, email, and related services (“Services”) we provide. The purpose of this AUP is to protect the integrity, reliability, and security of our network and services, ensure compliance with applicable laws, and maintain a safe environment for all users. By using our Services, you agree to abide by this AUP and all applicable laws and regulations. If you do not agree to this AUP, you must immediately stop using our Services.

2. Prohibited Activities

You may not use our Services in a way that is illegal, abusive, harmful, or inconsistent with industry standards. The following categories of activities are strictly prohibited:

2.1 Illegal or Unlawful Activities

Engaging in or facilitating any activity that violates local, national, or international law.
Hosting, distributing, or linking to counterfeit goods, pirated software, or stolen content.
Participating in money laundering, terrorist financing, or activities that breach trade or export regulations.
Example: Hosting a site selling unlicensed streaming subscriptions.

2.2 Fraud and Misrepresentation

Using our Services to commit or facilitate fraud.
Processing payments for goods or services not delivered or misrepresented.
Creating misleading domain names or websites impersonating another person or business.
Example: Hosting a fake e-commerce site to collect payment details.

2.3 Abusive, Offensive, or Harmful Content

Hosting or distributing content that is obscene, defamatory, harassing, or promotes violence or discrimination.
Publishing content that infringes copyrights, trademarks, or other intellectual property rights without authorization.
Operating sites that promote hate speech or exploitation.
Example: Hosting an illegal file-sharing service with copyrighted movies.

2.4 Security Threats and Network Abuse

Introducing malware, viruses, or other malicious code into our network or systems.
Attempting to bypass security measures, gain unauthorized access, or interfere with the performance of our Services.
Using automated tools (bots, scrapers) to overload or disrupt services.
Example: Running a denial-of-service attack from a hosted VPS.

2.5 High-Risk or Restricted Uses

Without our prior written approval, you may not use our Services for:

Adult content or services
Online gambling, betting, or lotteries
Unlicensed financial services or cryptocurrency exchanges
Sale of regulated substances without required licenses (e.g., alcohol, pharmaceuticals)

3. Enforcement and Violations

We reserve the right to investigate suspected violations of this AUP. If we determine that a violation has occurred, we may:

Suspend or terminate your account without prior notice.
Remove content that breaches this AUP.
Report activity to relevant authorities.
Seek recovery of costs incurred by our investigation or enforcement actions.
We are not responsible for any losses you may incur as a result of these actions.

4. Reporting Violations

If you believe someone is violating this AUP, report it to us at support@smartercloud.co.uk. Include:

Your contact information
A description of the suspected violation
Evidence (e.g., URLs, IP addresses, screenshots)
We may request additional details to assist our investigation.

5. Modifications to This Policy

We may amend this AUP at any time to reflect changes in laws, regulations, or operational requirements. Updates will be posted on our website with the “Last Updated” date revised accordingly. Continued use of our Services after updates constitutes your acceptance of the revised policy.

6. Governing Law

This AUP is governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
